If the “intent to use” application meets the applicable legal standards, a Notice of Allowance will be issued. The applicant will then have 3 years from the allowance date to submit a Statement of Use and Specimen. To keep the mark active, the applicant must file an extension application every 6 months after the Notice of Allowance and pay an extension fee for each Class in which the mark is being registered.
